Gorilla Ground Screws Limited

Terms & Conditions of Sale, Supply and Installation

August 2026

These Terms & Conditions apply to goods and services supplied by Gorilla Ground Screws Limited (“the Company”, “we”, “us” or “our”).

They are intended to cover, where applicable, ground screw foundations, Gorilla Ground Screw Bases, bespoke timber or steel base systems, design and CAD work, garden buildings supplied through us, third-party garden buildings, delivery, building assembly and associated installation services.

Nothing in these Terms & Conditions is intended to exclude or restrict any statutory rights which cannot lawfully be excluded or restricted.

1. Quotations and Orders

1.1. All quotations are based upon the information available to Gorilla Ground Screws Limited at the time of quotation, including information, photographs, videos, drawings, dimensions, plans and descriptions supplied by the customer.

1.2. The customer is responsible for ensuring that information supplied to us is complete and accurate.

1.3. If site conditions, dimensions, access requirements, levels, ground conditions, building specifications or other relevant circumstances materially differ from the information supplied to us, additional work and charges may be required.

1.4. Where additional work becomes necessary, we will wherever reasonably practicable explain the issue and obtain the customer’s agreement before undertaking material additional chargeable work.

1.5. An order becomes accepted when Gorilla Ground Screws Limited receives the required initial payment and confirms acceptance of the order.

1.6. By proceeding with an order, the customer confirms that they have been provided with and accept these Terms & Conditions.

2. Payments and Project Stages

2.1. Gorilla Ground Screws Limited operates a payment-before-work policy. Depending upon the nature and value of the project, payment may be required in full or through staged payments.

2.2. Where staged payments are agreed, each payment corresponds with the progression of the project and may authorise Gorilla Ground Screws Limited to incur further costs and commitments.

2.3. Unless otherwise stated on the quotation or invoice:

Stage One – Project Commencement

Receipt of the initial payment allows Gorilla Ground Screws Limited to:

  • open the customer’s project;
  • allocate project-management resources;
  • reserve provisional diary capacity;
  • commence desktop/site assessment;
  • commence CAD/design work where applicable; and
  • begin other preparatory work required for the project.

Stage Two – Design, Procurement and/or Base Manufacture

The second payment may authorise Gorilla Ground Screws Limited to:

  • progress or finalise CAD/design work;
  • procure materials;
  • manufacture or commission manufacture of a bespoke Gorilla Ground Screw Base;
  • cut or prepare materials specifically for the customer’s project; and
  • make further commitments to suppliers and subcontractors.

Stage Three – Building Production, Delivery and Installation

Where applicable, the final payment may authorise Gorilla Ground Screws Limited to:

  • place or release a bespoke building into manufacture;
  • procure a customer-selected third-party building;
  • arrange delivery;
  • commit installation labour and resources; and
  • proceed towards final installation.

2.4. The exact payment stages may differ between projects and will be shown on the customer’s quotation, invoice or other written order documentation.

2.5. No manufacture, procurement, delivery or installation is required to proceed while an amount properly due remains unpaid.

3. Provisional Installation and Production Dates

3.1. Unless expressly confirmed otherwise in writing, production, delivery and installation dates are provisional.

3.2. Gorilla Ground Screws Limited will make reasonable efforts to meet dates discussed or provisionally allocated with the customer.

3.3. Projects may nevertheless need to be rearranged because of circumstances including:

  • manufacturing delays;
  • supplier delays;
  • material shortages;
  • adverse or unsuitable weather;
  • unforeseen ground conditions;
  • illness or staff absence;
  • machinery or vehicle breakdown;
  • transport disruption;
  • previous installations taking longer than reasonably anticipated;
  • safety concerns;
  • circumstances outside our reasonable control; or
  • delays arising from third-party manufacturers or suppliers.

3.4. A reasonable change to a provisional production, delivery or installation date does not, by itself, constitute cancellation of the contract by Gorilla Ground Screws Limited.

3.5. This may include a delay of one or more weeks where reasonably necessary to complete manufacture, obtain materials, accommodate a third-party manufacturer’s production programme or safely and properly complete the project.

3.6. Where a date needs to change, Gorilla Ground Screws Limited will endeavour to inform the customer as soon as reasonably practicable and arrange the earliest reasonably available alternative.

4. CAD, Design and Customer Approval

4.1. Where a bespoke Gorilla Ground Screw Base is required, the customer will normally provide the building manufacturer’s floor plan, footprint and dimensions.

4.2. Gorilla Ground Screws Limited may use this information to create a corresponding base design and/or CAD drawing.

4.3. The customer is responsible for checking the drawing against their building specification before approving it.

4.4. Customer approval of a drawing confirms that the customer accepts the dimensions, footprint and other information shown and authorises Gorilla Ground Screws Limited to progress the project.

4.5. Once a drawing has been approved, materials may be ordered, cut, fabricated or manufactured specifically for the customer’s project.

4.6. Changes requested after approval may result in additional design, material, manufacturing, administration or installation charges.

4.7. Where correct information has been supplied by the customer but Gorilla Ground Screws Limited has made an error when producing its own design or drawing, Gorilla Ground Screws Limited will be responsible for rectifying its error.

4.8. Where the customer’s approved drawing is based upon incorrect dimensions, plans or specifications supplied by the customer or their building manufacturer, reasonable alteration or remanufacturing costs may be chargeable.

5. Customer Cancellation

5.1. Cancellation of an order after payment has been received may cause Gorilla Ground Screws Limited to incur costs and losses from the commencement of the project.

5.2. These may include:

  • administration;
  • project management;
  • CAD and design work;
  • site assessment;
  • procurement;
  • materials;
  • manufacture;
  • supplier commitments;
  • subcontractor commitments;
  • transport or accommodation commitments;
  • reserved installation capacity; and
  • diary capacity which cannot reasonably be resold following cancellation.

5.3. Consequently, cancellation does not necessarily entitle the customer to repayment of all sums previously paid.

5.4. Where a customer cancels, Gorilla Ground Screws Limited may deduct or recover reasonable costs and losses arising from the cancellation, subject to applicable consumer law and our obligation to take reasonable steps to reduce avoidable losses.

5.5. The amount will depend upon the stage the project has reached rather than solely upon the number of days remaining before installation.

For Gorilla Ground Screw Base projects, payment may be made in full or, where agreed, by staged payments. Once payment has been received, Gorilla Ground Screws Limited may immediately begin incurring costs and progressing the customer’s bespoke project, including project management, design and CAD work, procurement, material preparation, manufacture and the allocation of installation resources.

Accordingly, where a customer cancels after payment has been made, any refund will be calculated by reference to the stage the project has reached, the work already completed, costs incurred, materials committed, prepared or manufactured, supplier or subcontractor commitments made, and any reasonable losses arising from the cancellation.

6. Cancellation Before Manufacture

6.1. Where cancellation occurs before bespoke manufacture has commenced, Gorilla Ground Screws Limited may retain or charge an amount reasonably reflecting work already completed and commitments already made.

6.2. This may include design, CAD, administration, project-management and other preparatory costs.

6.3. Where an installation date has already been reserved and cancellation occurs sufficiently late that Gorilla Ground Screws Limited cannot reasonably reallocate that capacity, the resulting reasonable loss may also be taken into account.

7. Cancellation After Manufacture of a Bespoke Base

7.1. Gorilla Ground Screw Bases may be designed, cut and manufactured specifically for an individual customer’s project.

7.2. Manufacture may take place days or weeks before the proposed installation date and the completed base may subsequently be stored at our premises awaiting installation.

7.3. The fact that installation has not yet taken place does not mean that Gorilla Ground Screws Limited has not incurred manufacturing costs.

7.4. Where cancellation occurs after materials have been committed, cut, fabricated or manufactured specifically for the customer’s project, the customer may be responsible for the reasonable costs and losses associated with that bespoke work.

7.5. Gorilla Ground Screws Limited will take reasonable steps to mitigate its losses where materials can reasonably be reused or reallocated.

8. Late Cancellation and Rescheduling

8.1. Once an installation date has been allocated, Gorilla Ground Screws Limited reserves labour, vehicles, machinery and other resources for the customer’s project.

8.2. Where a customer cancels or requests postponement at short notice, Gorilla Ground Screws Limited may suffer a substantial loss if the reserved installation capacity cannot reasonably be reallocated.

8.3. In those circumstances, the customer may be responsible for reasonable losses resulting from the cancellation or postponement, including committed labour, travel, accommodation, transport and unrecoverable installation capacity.

8.4. Gorilla Ground Screws Limited will take reasonable steps to mitigate such losses, including attempting to reallocate diary capacity where reasonably practicable.

8.5. Any cancellation or rescheduling charge will be reasonable and proportionate to the loss actually incurred or reasonably expected to be incurred.

9. Cancellation by Gorilla Ground Screws Limited

9.1. Where Gorilla Ground Screws Limited determines that it cannot fulfil an order for reasons attributable to Gorilla Ground Screws Limited, and no reasonable alternative can be agreed with the customer, the customer will receive an appropriate refund, which may include a full refund of sums paid for work or goods which will not be supplied.

9.2. A reasonable postponement or rearrangement of a provisional installation, manufacturing or delivery date does notconstitute cancellation by Gorilla Ground Screws Limited.

9.3. Gorilla Ground Screws Limited will not be treated as voluntarily cancelling where performance is prevented or materially affected by:

  • the customer’s failure to provide access;
  • inaccurate or incomplete information;
  • unsafe site conditions;
  • undisclosed services or hazards;
  • non-payment;
  • failure to prepare the site;
  • missing customer-supplied materials or components;
  • customer interference with the works; or
  • other circumstances caused or controlled by the customer.

9.4. In such circumstances, reasonable costs already incurred and additional costs caused by the customer may remain payable.

10. Bespoke Garden Buildings
  1. Bespoke Garden Buildings – Design, Approval and Manufacture

10.1. For the purposes of these Terms & Conditions, a bespoke garden building includes any building which has been altered, adapted or manufactured differently from the standard off-the-shelf specification offered by one of Gorilla Ground Screws Limited’s trusted suppliers or manufacturers.

10.2. Bespoke alterations may include, without limitation, changes to dimensions, layout, door or window positions, roof design, cladding, colours, insulation, internal finishes or other customer-selected features.

10.3. During the early design stages, Gorilla Ground Screws Limited may provide sketches, illustrations, CGI images, examples or other visual material to assist the customer in developing their proposed building.

10.4. Such preliminary drawings, illustrations and CGI images are intended as visual representations only and should not be relied upon as final manufacturing drawings, dimensional drawings or confirmation of precise construction details.

10.5. The final manufacturing specification will be determined by the drawings and specifications produced or approved by the relevant manufacturer or its CAD/design team and subsequently approved by the customer.

10.6. The customer is responsible for carefully checking the final drawings and specification before approval, including dimensions, layout, door and window positions, roof orientation, external finishes and other material details shown.

10.7. Once final drawings or specifications have been approved by the customer, Gorilla Ground Screws Limited and/or the relevant manufacturer may immediately begin procurement, material preparation and manufacture.

10.8. Customer approval therefore constitutes authority to proceed with manufacture and to incur costs and commitments relating to the approved building.

10.9. Where the customer requests an alteration after approval, Gorilla Ground Screws Limited will use reasonable endeavours to assist. However, alterations cannot be guaranteed once procurement or manufacture has commenced and may result in additional design, administration, material, manufacturing, transport or installation charges.

10.10. Any additional costs resulting from customer-requested alterations after approval will be notified wherever reasonably practicable before the alteration proceeds.

10.11. Payments for bespoke buildings may be required in stages. Each payment corresponds with work, procurement, manufacture and commitments undertaken or about to be undertaken in progressing the customer’s project.

10.12. Where a customer cancels a bespoke building after drawings have been approved or procurement or manufacture has commenced, Gorilla Ground Screws Limited may retain sums already paid to the extent reasonably required to cover work completed, materials ordered or manufactured, supplier commitments, manufacturing costs and other losses arising directly from the cancellation.

10.13. Because bespoke and customer-specific goods may have little or no resale value, the amount refundable after manufacture has commenced may be substantially reduced and, depending upon the stage reached and costs already incurred or committed, there may be no refund due.

10.14. Gorilla Ground Screws Limited will take reasonable steps to reduce avoidable losses where materials or components can reasonably be reused, cancelled or reallocated.

10.15. Minor differences may occur between preliminary CGI images, visual representations and the completed building. Such images are intended primarily to illustrate the general appearance and layout of the proposed building.

10.16. Where timber or other natural materials are used, the customer acknowledges that colour, grain, knots, minor movement, shrinkage, expansion, checking and other naturally occurring characteristics may vary between individual components and may change over time.

10.17. Reasonable variations associated with natural materials or normal manufacturing tolerances do not of themselves constitute defects.

10.18. Where a bespoke building is manufactured by one of Gorilla Ground Screws Limited’s trusted suppliers or manufacturers, the manufacturer remains responsible for its applicable product warranties and guarantees.

10.19. Gorilla Ground Screws Limited will provide the customer with details of the relevant manufacturer where appropriate so that manufacturer warranty matters can be raised directly with them.

10.20. Gorilla Ground Screws Limited remains responsible for the installation workmanship undertaken by Gorilla Ground Screws Limited and for any other legal obligations which apply to us as retailer or supplier.

10.21. Manufacturing programmes and production dates are dependent upon the relevant manufacturer’s production schedule and may change because of circumstances including material shortages, staff absence, machinery breakdown, supply-chain delays or other matters outside Gorilla Ground Screws Limited’s reasonable control.

10.22. Customer-requested alterations after the building has been installed may be undertaken by Gorilla Ground Screws Limited where reasonably practicable but will normally constitute additional chargeable work unless required to remedy a defect for which Gorilla Ground Screws Limited is responsible.

10.23. Nothing in this section removes or restricts statutory rights relating to faulty goods, goods which are not as described, services not performed with reasonable care and skill or any other rights which cannot lawfully be excluded.

11. Affiliated and Third-Party Garden Building Manufacturers

11.1. Gorilla Ground Screws Limited works closely with an affiliated garden building manufacturer and may also source products from independent third-party manufacturers.

11.2. Our relationship with a manufacturer may allow us to assist with communication, specifications, drawings, collection, delivery and installation.

11.3. Gorilla Ground Screws Limited may act as an intermediary to help coordinate the process and provide the customer with a smoother overall service.

11.4. However, manufacturing facilities remain independently operated and Gorilla Ground Screws Limited does not control their internal production procedures, staffing, factory schedules or manufacturing processes.

11.5. Production dates supplied by manufacturers may therefore be subject to change.

11.6. Where a manufacturer’s production date changes, Gorilla Ground Screws Limited will use reasonable endeavours to obtain updated information and coordinate revised delivery and installation arrangements.

11.7. A manufacturer’s reasonable production delay which requires Gorilla Ground Screws Limited to rearrange a provisional installation date does not, by itself, constitute cancellation of the customer’s entire order by Gorilla Ground Screws Limited.

12. Customer-Selected Third-Party Buildings

12.1. Customers may ask Gorilla Ground Screws Limited to purchase or supply a specific building they have selected from an independent manufacturer.

12.2. Examples may include buildings manufactured by businesses with which Gorilla Ground Screws Limited has no affiliation.

12.3. Unless expressly agreed otherwise in writing, the customer is responsible for selecting the make, model, size and specification they wish Gorilla Ground Screws Limited to purchase.

12.4. Gorilla Ground Screws Limited may provide general practical information or advice based upon its experience, but this does not mean that Gorilla Ground Screws Limited has independently designed or professionally specified the customer’s selected building for a particular purpose.

12.5. The customer remains responsible for satisfying themselves that their selected building meets their requirements, including size, layout, insulation, appearance and intended use, unless Gorilla Ground Screws Limited has expressly undertaken responsibility for a particular specification in writing.

12.6. Gorilla Ground Screws Limited remains responsible for ordering the building which the customer has actually approved or instructed us to purchase.

13. Customer-Supplied Buildings and Assembly-Only Services

13.1. Gorilla Ground Screws Limited may agree to assemble a building purchased directly by the customer from another supplier.

13.2. In these circumstances, Gorilla Ground Screws Limited is providing an assembly service and is not the supplier or manufacturer of the building.

13.3. Unless expressly included within the quotation, the customer is responsible for:

  • receiving the building;
  • checking the delivery;
  • confirming that all components, fixings and instructions are present;
  • reporting missing or damaged components to their supplier; and
  • moving all components from the delivery location, including the front driveway or kerbside, to the installation area before our team arrives.

13.4. Installation time is allocated on the reasonable assumption that the complete building is present and ready for assembly.

13.5. Missing, damaged, incorrect or unsuitable components may prevent completion within the allocated installation period.

13.6. Gorilla Ground Screws Limited is not required to provide an additional attendance free of charge where completion was prevented by missing, damaged or incorrect customer-supplied components.

13.7. Any return attendance required after replacement or missing parts have arrived may be separately chargeable.

14. Building Assembly and Manufacturer Defects

14.1. Where Gorilla Ground Screws Limited is contracted to assemble a garden building, we will undertake the assembly with reasonable care and skill and in accordance with the manufacturer’s instructions where appropriate.

14.2. Gorilla Ground Screws Limited is responsible for defects resulting from its own installation workmanship, subject to these Terms & Conditions and applicable law.

14.3. Gorilla Ground Screws Limited is not the manufacturer of third-party components and cannot prevent manufacturing defects such as defective timber, warped doors, defective windows or other component failures.

14.4. Where a manufacturer accepts a component under its warranty and supplies a replacement part, the manufacturer’s warranty may cover the replacement component only.

14.5. Unless the defect arose because of Gorilla Ground Screws Limited’s installation workmanship, removal of the defective component and installation of the replacement component is not automatically included within the original assembly price.

14.6. Gorilla Ground Screws Limited may offer a separately chargeable service to return and install replacement components.

14.7. Nothing in this section restricts statutory consumer rights where Gorilla Ground Screws Limited is legally responsible as the retailer or supplier of the relevant goods.

Where Gorilla Ground Screws Limited installs a building manufactured by another company, our responsibility is limited to the assembly and installation work undertaken by us and, where applicable, our obligations as retailer or supplier under consumer law.

The customer should raise any visible concerns with the building or installation as soon as reasonably practicable, including on the day of installation where the issue is apparent at that time.

Where a defect becomes apparent after installation, Gorilla Ground Screws Limited will be given a reasonable opportunity to inspect and determine whether the issue arises from our installation workmanship or from the manufacture, design, materials or components of the building.

Gorilla Ground Screws Limited will not be responsible for defects which are attributable to the manufacturer, the product itself, customer-supplied components, normal material movement, maintenance, misuse or other causes unrelated to our installation workmanship, subject always to any statutory rights which apply where Gorilla Ground Screws Limited is legally responsible as the retailer or supplier.

15. Site Information and Ground Conditions

15.1. Quotations and base designs rely upon information available before attendance.

15.2. Customers must provide accurate information regarding:

  • site levels;
  • slopes;
  • existing bases;
  • concrete;
  • buried foundations;
  • access;
  • drainage;
  • ground conditions;
  • retaining structures;
  • underground services; and
  • other known obstacles or unusual conditions.

15.3. Where the customer states or represents that the site is substantially level but a material slope or level difference is discovered, longer screws, additional materials or design alterations may be required and may be chargeable.

15.4. Where Gorilla Ground Screws Limited has received accurate information but has incorrectly calculated the number or specification of screws required, reasonable corrective work arising from our calculation error will not be charged to the customer.

15.5. Where additional screws or upgrades are requested by the customer, these will be chargeable.

16. Unexpected Obstructions and Alternative Foundation Methods

16.1. Despite reasonable assessment, previously unknown buried concrete, foundations, obstructions or abnormal ground conditions may only become apparent during installation.

16.2. Discovery of such conditions does not automatically mean that Gorilla Ground Screws Limited will abandon the project.

16.3. We will use reasonable endeavours to identify a safe and practical alternative solution.

16.4. An alternative may involve a method outside our standard ground screw specification, including modification of a screw or use of concrete or another foundation method.

16.5. Where a proposed solution materially departs from our standard installation method, the customer will be informed before work proceeds and written approval may be required.

16.6. Any effect upon the warranty applicable to that particular element or installation method will be explained before the customer provides approval.

16.7. A non-standard solution will not automatically invalidate warranties relating to unrelated parts of the installation.

17. Underground Services and Utilities

17.1. The customer is responsible for notifying Gorilla Ground Screws Limited of all known or suspected underground services and hazards before installation.

17.2. This includes, but is not limited to:

  • electricity;
  • gas;
  • water;
  • sewage and drainage;
  • telecommunications;
  • oil or fuel lines;
  • irrigation systems;
  • private cables or pipes; and
  • any other underground infrastructure.

17.3. The customer may be required to complete and sign a pre-installation site and utilities declaration before work commences.

17.4. Detection and scanning equipment has technical limitations and cannot guarantee detection of every type of underground service or obstruction.

17.5. The use of scanning equipment does not remove the customer’s responsibility to disclose known or suspected services.

17.6. Gorilla Ground Screws Limited will exercise reasonable care when carrying out installation.

17.7. Subject to applicable law, Gorilla Ground Screws Limited will not normally be responsible for damage to an underground service which:

  • was not disclosed by the customer;
  • was not reasonably apparent;
  • could not reasonably have been identified using the agreed site procedures; and
  • was damaged despite our installers exercising reasonable care.
18. Access and Working Area

18.1. The customer must provide reasonable and safe access to the installation area.

18.2. Where requested, the customer must provide photographs, videos or other information showing access restrictions before the installation date.

18.3. The customer must disclose relevant restrictions including:

  • narrow gates or passageways;
  • steps;
  • walls or fences;
  • restricted parking;
  • overhead obstructions;
  • delicate landscaping;
  • steep slopes; and
  • any other issue affecting movement of machinery, materials or personnel.

18.4. Gorilla Ground Screws Limited will take reasonable care to minimise disturbance to the customer’s property.

18.5. However, installation may require the movement of heavy materials, timber, machinery and building components through gardens and other access routes.

18.6. Gorilla Ground Screws Limited cannot guarantee that lawns, plants, borders or other soft landscaping within necessary access or working areas will remain completely undisturbed.

18.7. The customer should move or protect particularly valuable, delicate or vulnerable plants and items before our arrival wherever reasonably possible.

19. Site Readiness and Wasted Attendance

19.1. The customer is responsible for ensuring that the site is reasonably ready for the agreed work.

19.2. If our team cannot commence or complete work because of circumstances within the customer’s control, additional charges may apply.

19.3. Examples include:

  • locked or inaccessible sites;
  • inadequate access;
  • customer-supplied materials not being present;
  • customer-supplied buildings not being moved to the installation area;
  • undisclosed obstructions;
  • unsafe conditions;
  • site preparation not having been completed as agreed; or
  • other trades preventing access to the working area.

19.4. Where possible, Gorilla Ground Screws Limited will work with the customer to find a practical solution.

19.5. Where an additional attendance becomes necessary because of circumstances attributable to the customer, a reasonable additional attendance, labour, travel and/or accommodation charge may apply.

20. Storage

20.1. Bespoke bases and other materials may be manufactured before the installation date and stored at Gorilla Ground Screws Limited’s premises.

20.2. Where storage forms part of our normal production and installation programme, no additional storage charge will normally apply.

20.3. Where goods are ready but installation or collection is postponed at the customer’s request, Gorilla Ground Screws Limited may provide up to 7 calendar days’ storage without charge.

20.4. After this period, storage may be charged at £5 + VAT per calendar day, unless a different storage charge has been agreed in writing because of the size or nature of the goods.

20.5. Storage charges will not apply where the delay is attributable solely to Gorilla Ground Screws Limited.

20.6. While goods remain in our possession, Gorilla Ground Screws Limited will take reasonable care of them.

21. Variations and Additional Work

21.1. The quotation covers the work and specification described in the quotation/order documentation.

21.2. Additional work requested by the customer or made necessary by materially inaccurate information or previously undisclosed conditions may be chargeable.

21.3. Wherever reasonably practicable, the customer will be informed of material additional costs before the additional work is undertaken.

21.4. Approval may be given in writing, electronically or by another recorded method agreed between the parties.

22. Natural Timber and Material Characteristics

22.1. Timber is a natural product and its appearance and dimensions can change with moisture, temperature and environmental conditions.

22.2. Natural characteristics may include:

  • knots;
  • grain variation;
  • colour variation;
  • minor splits or checking;
  • shrinkage;
  • expansion;
  • movement; and
  • other characteristics normally associated with timber.

22.3. Such characteristics do not necessarily constitute defects.

22.4. Garden buildings and external timber structures require appropriate maintenance by the customer in accordance with applicable manufacturer recommendations.

23. Installation Tolerances

23.1. Gorilla Ground Screws Limited will use reasonable care and skill when positioning and installing ground screws and base systems.

23.2. Due to ground conditions, underground obstructions and the nature of ground screw installation, absolute millimetre-perfect positioning cannot always be achieved.

23.3. Where a project requires particularly restrictive tolerances, the customer must notify Gorilla Ground Screws Limited during the design/planning stage.

23.4. Any project-specific tolerances agreed in writing will take precedence over standard working tolerances.

24. Completion and Customer Sign-Off

24.1. On completion of installation, the customer may be asked to inspect the work and sign a completion document.

24.2. The completion document records practical completion and provides the customer with an opportunity to identify visible concerns.

24.3. Signing the completion document does not remove statutory rights in relation to defects which could not reasonably have been identified at the time.

24.4. Where applicable, practical completion will mark commencement of the Gorilla Ground Screws Limited workmanship warranty.

25. Workmanship Warranty

25.1. Unless otherwise expressly stated in writing, Gorilla Ground Screws Limited provides a 12-month workmanship warranty in respect of its installation work.

25.2. The workmanship warranty covers faults resulting from installation work carried out by Gorilla Ground Screws Limited.

25.3. It does not cover problems arising solely from:

  • manufacturing defects in third-party products;
  • natural timber movement;
  • customer alterations;
  • misuse;
  • inadequate maintenance;
  • damage caused by third parties;
  • subsequent landscaping or construction;
  • abnormal ground changes occurring after installation; or
  • circumstances otherwise outside the reasonable control of Gorilla Ground Screws Limited.

25.4. Where a customer believes there is a workmanship defect, Gorilla Ground Screws Limited must be given a reasonable opportunity to inspect the issue and, where we are responsible, to provide an appropriate remedy.

25.5. Nothing in this warranty affects statutory rights.

26. Manufacturer Warranties

26.1. Garden buildings, windows, doors, roofing products and other third-party products may carry warranties provided by their respective manufacturers.

26.2. The duration and scope of those warranties are determined by the relevant manufacturer.

26.3. Where appropriate, Gorilla Ground Screws Limited may assist the customer in communicating with a manufacturer regarding a warranty claim.

26.4. A manufacturer’s agreement to supply a replacement component does not necessarily include labour to remove the original component or install the replacement.

26.5. Where Gorilla Ground Screws Limited was not responsible for the underlying defect, any requested return visit to install a replacement component may be separately chargeable, subject always to the customer’s statutory rights.

27. Safety During Installation

27.1. The installation area is a working construction area and may contain machinery, tools, ground screws, brackets, timber and other potentially hazardous materials.

27.2. Customers are responsible for keeping children, pets and unauthorised persons away from the working area.

27.3. Gorilla Ground Screws Limited may suspend work if installers reasonably believe that conditions are unsafe.

27.4. Threatening, abusive or dangerous behaviour towards our employees or subcontractors will not be tolerated and may result in work being suspended.

27.5. Suspension for genuine safety reasons or because of customer conduct will not automatically constitute cancellation by Gorilla Ground Screws Limited.

28. Planning Permission, Building Regulations and Other Consents

28.1. Unless expressly included within our written quotation, the customer is responsible for determining and obtaining any required:

  • planning permission;
  • Building Regulations approval;
  • landlord consent;
  • freeholder consent;
  • covenant approval;
  • neighbour agreement; or
  • other statutory or private consent.

28.2. Gorilla Ground Screws Limited may provide general practical information but does not provide legal or planning advice unless expressly agreed in writing.

29. Intellectual Property and Drawings

29.1. Drawings, CAD designs, base layouts, technical documents and other design materials produced by Gorilla Ground Screws Limited remain our intellectual property unless expressly agreed otherwise in writing.

29.2. They are provided for the purposes of the customer’s Gorilla Ground Screws Limited project.

29.3. They may not be reproduced, commercially exploited or supplied to another contractor for the purpose of reproducing our proprietary base design without our written consent, except where the customer has a legal right to do so.

30. Disposal and Site Clearance

30.1. Removal of existing bases, structures, soil, rubble, packaging or other waste is not included unless expressly stated within the quotation.

30.2. Where waste removal is requested, additional charges may apply.

30.3. The customer is otherwise responsible for lawful disposal of waste not expressly included within our agreed works.

31. Liability

31.1. Gorilla Ground Screws Limited will perform its services with reasonable care and skill.

31.2. Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.

31.3. Gorilla Ground Screws Limited will not be responsible for losses arising from inaccurate information supplied by the customer, undisclosed site conditions or matters outside our reasonable control except where liability cannot lawfully be excluded.

31.4. The customer is expected to take reasonable steps to minimise avoidable loss or damage where an issue arises.

32. Complaints and Remedial Work

32.1. If the customer has a concern about goods or services supplied by Gorilla Ground Screws Limited, they should notify their Project Manager or Gorilla Ground Screws Limited as soon as reasonably practicable.

32.2. We will investigate reasonable complaints and, where appropriate, request photographs, videos or a site inspection.

32.3. Where Gorilla Ground Screws Limited is responsible for defective workmanship, we must be given a reasonable opportunity to inspect and remedy the defect.

32.4. Customers should not commission another contractor to undertake remedial work at Gorilla Ground Screws Limited’s expense without first giving us a reasonable opportunity to investigate and remedy an issue, except where urgent action is reasonably necessary to prevent danger or further significant damage.

33. Customer Documentation

33.1. Depending upon the project, customers may be asked to sign or approve documents including:

  • CAD/base drawings;
  • building drawings;
  • site questionnaires;
  • utility declarations;
  • non-standard installation approvals;
  • variations;
  • completion forms; and
  • other project-specific documentation.

33.2. These documents form part of the project record and may supplement these Terms & Conditions.

34. Entire Agreement and Project-Specific Terms

34.1. These Terms & Conditions should be read together with the customer’s quotation, invoice, approved drawings, written variations and other agreed project-specific documentation.

34.2. Where a quotation expressly varies a commercial detail contained in these Terms & Conditions, the expressly agreed project-specific term will apply to that project.
